Plea in High Court to Bring Petrol & Diesel under GST
The inclusion of petrol and diesel in the Goods and Services Tax (GST) ambit was not possible until the revenues under the new tax regime stabilize.
The Madras High Court held that it wasn’t entrusted with the power to issue any directions to the Government for bringing fuel under the GST net. It was only the prerogative of Central Government to act on the recommendations of GST Council.
Madurai: Seeking to bring petrol and diesel under the ambit of GST a petition has been filed at the Madurai bench of the Madras High Court. The petitioner, K.K. Ramesh said that the main aim of GST is one nation one tax. But petrol and diesel have not come GST. Due to this, the fuel prices are rising day by day.
Minister of Petroleum and Natural Gas, Dharmendra Pradhan recently said that the GST council should consider bringing petroleum product in its ambit. If it is done so, the prices of petroleum product will come down.
Demanding to bring these fuels under the GST, the petitioner sent a representation to the Prime Minister’s Office and other officials concerned but no action said by petitioner was taken.
As petrol and diesel are widely used intermediate inputs, the thinking was that the GST revenues have to stabilize before they can be brought in, because you need to have enough other revenues to cushion for the loss of putting petroleum into the GST.
